Rosenthal Law Group is pleased to announce that its Petition for Rehearing En Banc that it filed in the Eleventh Circuit Court of Appeals in the case of United States of America v. Estelle Stein, Case No. 16-10914, has been granted.
On March 23, 2017, the Eleventh Circuit Court of Appeal entered an Order advising that the case of Estelle Stein will be reheard en banc and vacated the three-judge panel’s previous order affirming summary judgment in favor of the United States of America.
The Order indicates that a majority of the Eleventh Circuit Court of Appeal’s eleven active judges voted to grant Rosenthal Group’s Petition for Rehearing En Banc and that Circuit Judge Jill Pryor was recused from this case.
Review of a panel decision by the full court en banc is extremely rare so the Eleventh Circuit’s decision to rehear the case of Estelle Stein signals the importance of the issues raised by Rosenthal Group in this appeal. Oral argument has not yet been set.
